Identity Theft under Texas Law

According to Texas Penal Code §32.51, a person commits identity theft if he or she obtains, possesses, transfers, or uses identifying information of another person without the other person’s consent and with intent to harm or defraud another.

“Identifying information” means information that alone or in conjunction with other information identifies a person, including a person’s:

  • name and date of birth;
  • unique biometric data, including the person’s fingerprint, voice print, or retina or iris image;
  • unique electronic identification number, address, routing code, or financial institution account number;
  • telecommunication identifying information or access device; and
  • social security number or other government-issued identification numbers.

Identity theft is considered a state jail felony. If convicted of a state jail felony in Texas, the presumptive sentence will be no more than two years and not less than 180 in jail, along with a fine not to exceed $10,000.
